Hello kollel!

The rambam notes the king may take a 10th of produce and animals.

How does this interact with regular maaser? Does the king take first? Does he take after maaser rishon but before maaser sheni/ani? How does it work in shmitta?

The Kollel replies:

The Radak (Shmuel I 8:15) states that Ma'aser ha'Melech is after Ma'aser ha'Leviyim (Ma'aser Rishon). I would assume that the same is true about Ma'aser Sheni/Ani but I have no source to prove that. In Shemitah, the king, just like everybody else, may take what he wants, so it is probably a moot point in Hilchos Melachim.

Perhaps we could ask whether the king is prohibited from taking more Shevi'is fruits than he needs (like everyone else) or if the Din of Ma'aser supercedes the Din of Shevi'is. I do not have a proof, but to my mind, the question does not begin, because when it comes to Halachic adherence and following the will of Hashem, the king is a commoner like everybody else.

Our Prayer and hope: All the gates to the Har haBayit have to be opened for Jews and non-Jews seven days in the week 24 hours a day. The Jews need to have the freedom to go with Tefillin, Tallit and Torah Scroll up on the Mountain to serve Hashem. And do קידה ('Kidah' prostate, laying down, before Hashem) Everyone showing his/her respect for the Jewish and all other religions. But NOT for the words/deeds/sins spoken against any word of the Torah of Moshe Rabbeinu and the 'real' teachings of the Jewish Rabbis. The Jews must be the guardians of the Har haBayit.

What is the difference between a Prime Minister elected by a nation, and a court put in place by a few? A Democracy is governed by a Prime Minister that is elected by the nation, not by a court put in place by a few. A government that rules by a court is a Kritarchy!
