SUMMARY

Rebbi Meir says that a Sotah who is pregnant or nursing from a previous marriage does not drink the Mei Sotah and does not receive a Kesuvah.
 
Rebbi Meir holds that a person who marries a pregnant or nursing woman must divorce her and never remarry her.
 
The Chachamim hold that he may remarry her after the child is two years old.
 
If a childless person marries a woman who is infertile or old she does not drink the Mei Sotah and she does not receive a Kesuvah.
 
Rebbi Eliezer says that even though she is infertile she drinks the Mei Sotah because her husband can marry a second wife.
 
If a person is Mekanei his Arusah or Shomeres Yavam and the Setirah takes place after the Nisu'in she drinks the Mei Sotah.
 
The permitted wife of a Mamzer, or Nasin, or the wife of a Ger or freed servant must drink the Mei Sotah.
 
Rebbi Shimon Ben Eliezer says that an Ailonis may not drink the Mei Sotah. (1)
 
Rebbi Akiva says that if the Sotah was innocent if she was previously infertile she will now have children.
 
Rebbi Yishmael says that if she previously gave birth with difficulty or she had girls or dark or short kids she will now give birth pain free to male, light skinned or tall kids.
 
The wife of a Kohen may drink the Mei Sotah even though she is forbidden to her husband even if she was raped.
 
If a Sotah who is the wife of a Kohen did not die from the Mei Sotah she is permitted to her husband even if her limbs hurt after drinking the water.
 
The wife of a Saris may drink the Mei Sotah.
 
A Kinuy for a relative is a valid Kinuy.
 
A Sotah is forbidden to her husband and to the Bo'el.
 
A Kinuy for a Katan is not a Kinuy, however a Kinuy for a Shachuf or a Nochri is a valid Kinuy. (2)
 
If a Bas Kohen had relations with a Shachuf who is Pasul or with a Nochri or servant she is Pesulah for Terumah.
 
A Kinuy for an animal is not a Kinuy because relations with an animal is not considered Znus.
 
An Esnan given to a Zonah for relations with a dog, or an animal that is exchanged for a Zonah are permitted for a Korban.
 
A Kinuy she'Lo k'Darkah is a valid Kinuy.
 
It is a Machlokes whether Ha'arah is Neshikah or Hachnasas Atarah.
 
A Kinuy Derech Eivarim is not a valid Kinuy.

A BIT MORE

1. Rebbi Shimon Ben Elazar holds like Rebbi Eliezer that an Akarah or Zekeinah drinks the Mei Sotah however he learns out from a Pasuk that an Ailonis does not drink the Mei Sotah.
 
2. A Shachuf is a person whose flesh is dried out and is infertile.

BRIEF INSIGHT

A PREGNANT SOTAH
 
The Beraisa says that a Sotah who is pregnant from her husband must drink the Mei Sotah. Rashi says that the Chidush is that we are not concerned for the life of the child and we give her to drink even though the child will die along with her. Tosfos says that we certainly do not give the Sotah to drink while she is pregnant and we must wait until she gives birth. The Chidush according to Tosfos is that even though we cannot give her to drink while she is pregnant we do not push it off entirely and she does have to drink as soon as she gives birth.

QUICK HALACHAH

INNOCENT
 
A Sotah who drank the Mei Sotah and did not die immediately is permitted to her husband even if he is a Kohen. Even if she started feeling sick and her limbs were ill since her stomach was not swelling and her thigh was not falling she is permitted. However once her stomach starts swelling and her thigh starts falling she is definitely prohibited to her husband. A woman who drank the Mei Sotah and she was innocent she is revitalized, her face shines and if she was ill she will recover. She will conceive and give birth to a son. If she previously gave birth with difficulty she will now give birth easily and if she previously gave birth to girls she will now give birth to boys. (Rambam Hilchos Sotah 3:21,22)

SUMMARY

Shmuel says that it is better to marry a woman of bad repute than her daughter. (1)
 
Rebbi Yochanan says that it is better to marry the daughter of a woman of bad repute than to marry the mother. (2)
 
The daughter of a woman who is Mezaneh is Kosher because most Bi'os are from the husband. (3)
 
It is a Safek if the children of a woman who is extremely promiscuous are Pesulim. (4)
 
It is a Machlokes whether a woman conceives the day before her Veses or during the day after her Tevilah.
 
Beis Din is Mekanei the wife of a deaf mute or Shoteh and the wife of someone who is overseas or in jail, but she does not drink the Mei Sotah. (5)
 
Rebbi Yosi says that when Beis Din is Mekanei the wife of someone who is in jail the husband may give her to drink when he is released.
 
If the husband or wife is blind, lame or mute she may not drink the Mei Sotah.
 
The Mei Sotah affects both the Sotah and the Bo'el.
 
A Sotah is forbidden to her husband and to the Bo'el.
 
Rebbi Akiva says that a Sheni conveys Tum'as Shlishi.
 
One thousand Amos outside the cities of the Leviyim are Migrash (open space).
 
Rebbi Akiva says that the Techum Shabbos is 2000 Amos.
 
Rebbi Eliezer the son of Rebbi Yosi ha'Glili says that after the thousand Amos of Migrash, another thousand Amos outside the cities of Leviyim were field and vineyards.
 
Rebbi Yehoshua Ben Hurkenus says that Iyov served Hashem from love while Rebbi Yochanan Ben Zakai says that he served Hashem from fear.

A BIT MORE

1. The woman of bad repute is of unquestioned lineage while her daughter is not.
 
2. Because the daughter has a Chezkas Kashrus and the mother does not and there is a concern that she will be Mezaneh under her husband.
 
3. For this reason the Halachah follows Rebbi Yochanan that it is better to marry the daughter since she is Kosher than to marry the mother who may be Mezaneh without her husband realizing it.
 
4. According to the opinion that a woman conceives the day before her Veses of Nidah her children are definitely Pasul because her husband does not know when her Veses will be and he cannot guard her in order to ensure that she will not be Mezaneh at a time that she may conceive. According to the opinion that a woman conceives on the day after her Tevilah it may be possible for the husband to guard her at that time and therefore it is a Safek if her children are Kosher.
 
5. The Kinuy of Beis Din is only for the purpose of stripping her of her Kesuvah and prohibiting her on her husband.

BRIEF INSIGHT

MOTHERS AND DAUGHTERS
 
The daughter of a woman who is Mezaneh is Kosher because most Bi'os are from the husband. The Meiri says that even though the daughter is Kosher a person should l'Chatchilah avoid marrying the daughter of a woman of bad repute because of the concern that the daughter will follow in the ways of her mother and will be Mezaneh under her husband.

QUICK HALACHAH

THE FATE OF THE BO'EL
 
At the same time that the Sotah dies the Bo'el will die as well wherever he may be. He will undergo the same death as the Sotah and his stomach will swell and his thigh will fall. However that is only if the husband never was Bo'el a forbidden Bi'ah in his life, but if the husband was Bo'el a forbidden Bi'ah at any time in his life the water will not affect the Sotah [or the Bo'el]. (Rambam Hilchos Sotah 3:17)

SUMMARY

If the husband is guilty of a sin the Mei Sotah will not affect his wife. (1)
 
The Mei Sotah affects both the Sotah and the Bo'el.
 
A Sotah is forbidden to her husband and to the Bo'el.
 
The Kohen notifies the Sotah that the stomach is stricken first followed by the thigh. (2)
 
A Sotah is prohibited from eating Terumah. (3)
 
A divorcee may eat Terumah but she may not marry a Kohen. (4)
 
A Sotah may not marry a Kohen.
 
If a married woman had relations with another man b'Shogeg or b'Ones she is permitted to her husband. (5)
 
A Safek Tum'ah in Reshus ha'Yachid is Tamei if the object of the Safek has Da'as. (6)
 
A Safek Tum'ah in Reshus ha'Rabim is Tahor.

A BIT MORE

1. If he had relations with his wife after the Setirah the Mei Sotah will not have any affect.
 
2. Even though in one of the Pesukim it states the thigh first, however the water affects the Sotah as it goes down her throat and it first goes into the stomach before going into her thigh.
 
3. Even if she is a Bas Kohen or the wife of a Kohen.
 
4. If a divorcee is a Bas Kohen and she does not have any children from a non-Kohen she may go back to eating Terumah after she is divorced.
 
5. However if she is married to a Kohen she is prohibited to her husband.
 
6. If the object of the Safek does not have Da'as a Safek Tum'ah is Tahor even in Reshus ha'Yachid.

BRIEF INSIGHT

SHOGEG OR ONES
 
If a Sotah is Shogeg or Ones she is permitted to her husband if he is not a Kohen. If the Sotah is Shogeg and the Bo'el is Mezid the water will have no affect at all and even the Bo'el will survive. When the Bo'el was Mezid even though the Sotah was Shogeg and is permitted to her husband however she is forbidden to the Bo'el since he was Mezid. (Meiri in the name of the Yerushalmi)

QUICK HALACHAH

PROHIBITED RELATIONS
 
Any man who was Bo'el a prohibited Bi'ah any time after he became a Gadol the Mei Sotah will not affect his wife. Even if he had relations with his Arusah in the house of his father-in-law which is forbidden mid'Rabanan the water will not affect his wife. (Rambam Hilchos Sotah 2:8)

SOTAH 29 (19 Sivan) - Dedicated in memory of Shlomo Aumann (son of Professor Yisrael Aumann of Yerushalayim), Talmudic Scholar and man of the world, killed in action in Lebanon on the eve of the 19th of Sivan, 5742.

SUMMARY

A Sotah is prohibited to Kehunah and she may not eat Terumah.
 
A Safek Tum'ah in Reshus ha'Yachid is Tamei if the object of the Safek has Da'as. (1)
 
If the Nitma has Da'as even if the Metamei does not have Da'as a Safek Tum'ah in Reshus ha'Yachid is Tamei.
 
A Tvul Yom may eat Chulin but if he touches Terumah he makes it Pasul.
 
A Sheni makes a Shlishi for Terumah.
 
Food can never become an Av ha'Tum'ah. (2)
 
An earthenware utensil cannot become an Av ha'Tum'ah.
 
An earthenware utensil is Mitamei from the interior.
 
A Shlishi makes a Revi'i b'Kodesh.
 
A Mechusar Kipurim is permitted to eat Terumah but if he touches Kodesh it is Pasul.
 
A Shlishi is Pasul for Kodesh from the Torah.
 
A Shlishi makes Kodesh into a Revi'i from a Kal va'Chomer.
 
Abba Shaul says that a Tvul Yom is Metamei Kodesh and makes it into a Sheni. (3)
 
Rebbi Meir says that a Tvul Yom is Metamei Terumah and Kodesh and makes it into a Shlishi. (4)
 
The Chachamim say that a Tvul Yom makes Terumah and Kodesh Pasul, but not Tamei. (5)

A BIT MORE

1. If the object of the Safek does not have Da'as, a Safek Tum'ah is Tahor even in Reshus ha'Yachid.
 
2. Even if it comes into contact with a Mes it will not be an Av ha'Tum'ah.
 
3. The Kodesh is Metamei Terumah and Kodesh upon contact, and the Terumah or Kodesh in turn makes Kodesh Pasul upon contact.
 
4. The Kodesh will make other Kodesh Pasul upon contact, but it would have no affect on Terumah.
 
5. The Kodesh will have no affect on Terumah or Kodesh that it comes into contact with.

BRIEF INSIGHT

SETIRAH WITH A KETANAH
 
The Gemara says that regarding a Sotah both the Noge'a and the Magi'a have Da'as. The Rambam holds that a Ketanah who is a Sotah is forbidden to her husband even though she does not drink the Mei Sotah. The Ketzos asks why the Din of Sotah applies to a Ketanah. A Ketanah does not have Da'as! The Ketzos answers that just as the Gemara concludes that Da'as Magi'a is not necessary as long as we have Da'as Noge'a, the reverse is true as well. If there is Da'as Magi'a even if there is no Da'as Noge'a the Din of Sotah will apply. Therefore even if the Sotah is a Ketanah and there is no Da'as Noge'a, as long as the Bo'el is a Gadol so that we have Da'as Magi'a the Din of Sotah will apply.

QUICK HALACHAH

A RISHON AND A SHENI
 
A Rishon and Sheni for Terumah is Tamei and is Metamei and a Shlishi is Pasul and is not Metamei. A Shlishi cannot make Terumah into a Revi'i. A Tvul Yom is prohibited from eating Terumah until he undergoes He'erev Shemesh and if he touches Terumah it is Pasul. A Tvul Yom is like a Sheni and therefore we learn from here that a Sheni makes Terumah into a Shlishi. (Rambam Hilchos Avos ha'Tum'ah 11:3)

SUMMARY

A Sheni of Chulin is Tamei.
 
Rebbi Meir, Rebbi Yosi, Rebbi Yehoshua, Rebbi Elazar and Rebbi Eliezer hold that a Sheni cannot make Chulin a Shlishi.
 
Rebbi Meir says that anyone who requires Tevilah mid'Rabanan is Metamei Kodesh and is Posel Terumah. (1)
 
Rebbi Eliezer says that someone who eats a Rishon becomes a Rishon and if he eats a Sheni he becomes a Sheni.
 
Rebbi Yehoshua says that if a person eats a Rishon or a Sheni he becomes a Sheni and if he eats a Shlishi he becomes a Sheni l'Kodesh but not for Terumah. (2)
 
Rebbi Elazar says that a Rishon of Chulin, Terumah and Kodesh share the same status. (3)
 
Rebbi Eliezer says that Chalah may be separated from dough that is Tahor for dough that is Temei'ah, but the Chachamim argue.
 
According to Rebbi Eliezer when separating Chalah Tehorah for dough that is Tamei, some dough must be placed as a bridge between the dough that is Tamei and the dough that is Tahor. (4)
 
It is questionable whether dough that Chalah has not yet been separated from maintains the status of Chulin or of Chalah regarding Tum'ah.
 
It is questionable whether it is permitted to convey Tum'ah to Chulin in Eretz Yisrael.
 
Rebbi Akiva holds Techumim are Min ha'Torah and Rebbi Elazar holds that they are mid'Rabanan.
 
Rebbi Akiva says that Klal Yisrael responded to the Shirah of Moshe with the Roshei Perakim just as one responds to a Gadol who is reciting the Hallel. (5)
 
Rebbi Yosi ha'Glili says that Klal Yisrael responded to the Shirah of Moshe verse by verse just as one responds to a Katan who is reciting the Hallel. (6)
 
Rebbi Nechemyah says that Klal Yisrael sang the Shiras ha'Yam along with Moshe, however Moshe started first and Klal Yisrael followed after him. (7)
 
Rebbi Meir says that even fetuses in their mother's stomach sang the Shiras ha'Yam.

A BIT MORE

1. According to Rebbi Meir he is permitted to eat Chulin and Ma'aser, but the Chachamim hold that he may not eat Ma'aser.
 
2. Chulin can become a Shlishi if it is eaten Al Taharas Terumah and if he eats a Shlishi and he comes into contact with Kodesh it becomes a Shlishi.
 
3. They are Metamei two and Posel one of Kodesh and Metamei one and Posel one of Terumah and Posel one of Chulin.
 
4. Some say that dough less than the size of an egg is used as a bridge because the size of an egg conveys Tum'ah, while others hold that dough the size of an egg is placed between them.
 
5. When a Gadol is Motzi the congregation with Hallel the congregation responds with the Roshei Perakim.
 
6. If a Katan is reciting the Hallel to the congregation everyone must respond verse by verse because a Katan cannot be Motzi the Tzibur.
 
7. Just as a Sofer who recites the blessings of the Keri'as Shema for the Tzibur starts first and subsequently the entire Tzibur recites the blessings together.

BRIEF INSIGHT

TECHUMIM
 
Rebbi Akiva holds Techumim are Min ha'Torah and Rebbi Elazar holds that they are mid'Rabanan. The Rambam in his commentary on Mishnayos says that even according to Rebbi Elazar Techumim are mid'Oraisa, however the Torah did not give a Shi'ur for the Techum and the Rabanan decreed that the Shi'ur is 2000 Amos.

QUICK HALACHAH

TECHUMIM
 
Each person may walk 2000 Amos in any direction besides his four Amos or besides the [enclosure] that he was residing in at the time of the commencement of Shabbos. (Shulchan Aruch OC 397:1)
 
This is a Rabbinic ordinance because Min ha'Torah a person may walk 12 Mil which was the size of the Machaneh Yisrael in the Midbar. Many Poskim hold however that Min ha'Torah a person can walk even more than 12 Mil and the prohibition of Techumim is strictly mid'Rabanan. (Mishnah Berurah)

Under HaShem’s Righteousness the Har HaBayit shall become a Prayer House for all peoples. Jews, Muslims, and Christians when they put away Avoda Zara and their false doctrines……

By annulling that covenant made with the Islamic authorities in ’67 on the Har Habayit and all other covenants, banning all crimes and abominations by PA, Hamas and Islamic Jihad with an Iron fist declaring Jewish Sovereignty in all the Land Hashem gave the Jewish People in ’67.

Our Prayer and hope: All the gates to the Har haBayit have to be opened for Jews and non-Jews seven days in the week 24 hours a day. The Jews need to have the freedom to go with Tefillin, Tallit and Torah Scroll up on the Mountain to serve Hashem. And do קידה ('Kidah' prostate, laying down, before Hashem) Everyone showing his/her respect for the Jewish and all other religions. But NOT for the words/deeds/sins spoken against any word of the Torah of Moshe Rabbeinu and the 'real' teachings of the Jewish Rabbis. The Jews must be the guardians of the Har haBayit.



תפילתנו ותקוותנו: כל שערי הר הבית צריכים להיפתח עבור יהודים ולא-יהודים שבעה ימים בשבוע 24 שעות ביממה. ליהודים צריך להיות חופש ללכת עם תפילין, טלית וספר תורה במעלה ההר כדי לשרת את ה' ולקוד קידה .מתוך הפגנת כבוד ליהודים ולכל הדתות האחרות, אבל לא למילים/למעשים/לחטאים הנאמרים נגד תורת משה רבנו. מלמודי רבנים, היהודים חייבים להיות שומרי הר הבית.



   

Let's pray for a death sentence for the Palestinian Authority, Hamas, Hezbollah and for the continuation of the Jewish settlement in Judea and Samaria. The Palestinian Authority, Hamas and Hezbollah must disappear. Enough of the hatred from the world (the USA, the European Union, and the UN!) against the Jewish people.
